New Zealand Enacts Legislation to Create a Regulated Online Casino Licensing Framework
New Zealand has taken a significant step toward formalizing its online gambling landscape with the passing of the Online Casino Gambling Bill, which received its third and final reading in Parliament on April 23. This legislation introduces a structured licensing system for online casino operators and grants the Department of Internal Affairs expanded authority to oversee and enforce the new regulatory framework.
The new approach will see up to 15 online casino licenses issued competitively. Only operators who obtain a license will be permitted to offer online gambling services within New Zealand, and they will be required to adhere to the country’s regulations. Additionally, the bill addresses a previously identified loophole in gambling taxation, ensuring that licensed online operators will pay taxes on par with other domestic businesses.
To protect consumers, the government has linked the new licensing regime to enhanced safeguards for players. Licensed operators will be mandated to implement measures that exclude problem gamblers and align with harm prevention and consumer protection standards set forth by the law. Further regulations are expected to clarify advertising practices, harm reduction strategies, consumer protections, and the fees and levies needed to sustain the system.
The Department of Internal Affairs will oversee the enforcement of these regulations, equipped with a range of powers including issuing take-down notices, formal warnings, enforceable undertakings, and levying fines of up to NZ$5 million for serious or repeated violations. These measures aim to extend New Zealand’s legal reach over all online gambling activities available within its borders, including those operated overseas, thereby reducing opportunities for evasion and bolstering compliance monitoring.

Brooke van Velden, New Zealand’s Minister of Internal Affairs, highlighted the community-focused aspect of the legislation, emphasizing the importance of channeling gambling proceeds into local initiatives. She stated, “Submissions on this Bill made it clear that New Zealanders also want the benefits from the online casino gambling to flow back to local sports clubs, community groups, and grassroots organisations. This Bill delivers on that expectation.” Following its passage, the bill will proceed to Royal assent, with the government planning to develop the necessary regulations later this year to facilitate the rollout of the licensing system.
